1. TERMS OF USE (TOU)

1.1 Acceptance and Binding Effect

By accessing, browsing, or using the NDT Lab Reporting cloud-based software environment
(the “Application”), the user expressly acknowledges that they have carefully reviewed,
understood, and unconditionally accepted these Terms of Use (“Terms”).

These Terms form a legally binding agreement between the user and the Hellenic Institute of
Non-Destructive Testing (HINDT) (the “Provider”), fully enforceable under Greek and EU law.

Continued use of the Application constitutes full acceptance of all provisions herein.

Any user who disagrees with any clause must immediately discontinue use.

1.2 Intellectual Property and Proprietary Rights

All components of the Application—including but not limited to source code, object code,
design structures, algorithms, user interfaces, database schemas, report templates,
methodologies, and all derivative works—are the exclusive property of HINDT.

They are protected under:

  • Greek Law 2121/1993 (Copyright Law)
  • EU Directives 2001/29/EC and 2009/24/EC
  • International treaties (Berne Convention, TRIPS)

The user is strictly prohibited from:

  • reproducing, copying, distributing, or modifying any part of the Application,
  • reverse engineering, decompiling, disassembling, deobfuscating, or extracting source code,
  • bypassing or attempting to circumvent security controls, licensing constraints, or technical restrictions,
  • exploiting, misusing, or tampering with Application infrastructure.

Any violation may result in civil and criminal liability.

1.3 Description of the Service

The Application provides digital tools for:

  • managing, organizing, and storing NDT-related data
  • generating, exporting, and formatting inspection reports
  • processing metadata and accompanying materials

The Provider may modify, upgrade, discontinue, or restrict portions of the Application at any time
without liability.

1.4 Extended Disclaimer of Liability

1.4.1 Scope of Exclusion

To the maximum extent permitted by law, the Provider shall bear no liability—contractual, tortious,
statutory, strict, or otherwise—for any direct or indirect damages arising from the use of the Application,
including but not limited to:

  • data loss, deletion, corruption, or inaccessibility
  • system downtime, outages, failures, or latency
  • third-party infrastructure failures
  • cyberattacks, unauthorized access, security breaches
  • inaccuracies or errors in generated reports
  • financial, operational, reputational, or scientific damage
  • decisions taken on the basis of exported data

1.4.2 Cloud-Specific Risks

The user acknowledges that cloud-based systems inherently carry risks of data loss, service interruption,
and irrecoverability.

The Provider makes no guarantee regarding preservation, integrity, or availability of stored data.

1.4.3 Waiver of Legal Claims

The user expressly waives any right to pursue litigation, indemnification, damages, class actions,
or injunctive relief against the Provider for any matter arising from the Application’s operation or performance.

1.5 User Responsibilities

The user agrees and warrants that they shall:

  • Maintain independent external backups of all data.
  • Verify the accuracy, validity, and completeness of all entries and measurements.
  • Understand that the Application is an organizational tool, not a certifying or validating authority.
  • Independently evaluate all generated reports before use.
  • Comply with all applicable national and EU regulations.

The Provider bears no responsibility for user-generated content.

1.6 Amendments

The Provider may revise these Terms at any time. Updates take effect immediately upon publication.

1.7 Governing Law and Jurisdiction

This Agreement is governed exclusively by Greek law.

Any dispute shall fall under the exclusive jurisdiction of the Courts of Athens.

The user irrevocably waives all objections relating to venue or forum.

2. ADDITIONAL OPERATIONAL TERMS

2.1 Scope of the Application

The Application is a specialized professional tool enabling structured management of NDT inspections,
datasets, media, observations, and exported technical reports.

It may include both Free and Premium functionalities, subject to registration and/or purchase.

The Application does not perform certification, conformity validation, or technical approval of NDT operations.

2.2 Account Registration and Security

Certain functionalities require user registration. The user agrees that:

  • All registration information must be accurate and updated.
  • Credential confidentiality is solely the user’s responsibility.
  • All activity under the user’s account is attributed to the user.
  • Account sharing or sublicensing is strictly prohibited.
  • Suspicious activity may result in immediate termination without refund.

2.3 Free and Premium Features

2.3.1 Free Features

Limited functionality may be available without payment, including constrained data storage or export capabilities.

2.3.2 Premium Features

Premium Features are accessible through non-recurring fee-based access.
Premium features may change, expand, or be discontinued at any time without notice.

2.4 Prohibited Activities (Strict Technical Restrictions)

The user shall not:

  • Use the Application for any illegal, unauthorized, or unethical purpose.
  • Interfere with, disrupt, or attempt to exploit the Application’s infrastructure.
  • Perform any form of reverse engineering, decompilation, disassembly, or code extraction.
  • Attempt to bypass security controls, subscription mechanisms, watermarking, export restrictions, or server protections.
  • Upload unlawful, falsified, infringing, or malicious data.
  • Access or manipulate NDT content to which they have no lawful rights.
  • Conduct penetration testing or attempt unauthorized access.
  • Use automated tools, scraping, data harvesting mechanisms, or system tampering methods.

Refunds are not provided for violations of prohibited-use clauses.

2.5 Payment and Refunds

2.5.1 Premium Access

The user agrees to pay the applicable fees to access Premium functionalities.

Payments are one-time unless otherwise specified.

2.5.2 Refunds

Refund requests are accepted only at the Provider’s discretion, if:

  • submitted within two (2) hours of payment,
  • the user provides a detailed justification,
  • Premium features have not been accessed or used.

The Provider reserves the right to decline any refund request.

2.6 Extended Intellectual Property Terms

2.6.1 Ownership of the Application

All software, structures, and documentation are proprietary to HINDT.
No rights are granted beyond a limited, revocable license to use the Application.

2.6.2 Third-Party Systems

If the Application interacts with external systems, the user acknowledges that:

  • HINDT is not affiliated with external platforms unless explicitly stated.
  • The user must comply with any third-party terms.
  • The Application must not be used to unlawfully access or extract third-party data.

2.7 Disclaimer of Association

The Application is not affiliated or endorsed by any external laboratory, authority, or commercial entity.
All third-party trademarks remain the property of their respective owners.

2.8 Indemnification

The user agrees to indemnify and hold harmless HINDT against all claims arising from:

  • misuse of the Application,
  • breach of these Terms,
  • violation of laws or IP rights,
  • submission of harmful or unauthorized content.

3. GDPR COMPLIANT PRIVACY POLICY

3.1 Roles Under GDPR

The User (or their organization) is the Data Controller.

HINDT acts as Data Processor, processing data strictly under documented instructions.

3.2 Categories of Data Processed

The Application may process:

  • identification data (name, email),
  • device logs and system telemetry,
  • NDT data (images, measurements, metadata, notes),
  • timestamps and technical events.

No special-category data is collected unless submitted by the user.

3.3 Purposes of Processing

Data are processed solely for:

  • providing access,
  • generating and exporting reports,
  • security and system integrity,
  • compliance with legal obligations.

3.5 Data Retention

Data are retained for the duration of the account’s lifecycle.

Deletion occurs within 365 days of termination unless legally required otherwise.

3.6 Security Measures

HINDT applies technical and organizational safeguards.

Absolute security cannot be guaranteed.

4. DATA PROCESSING AGREEMENT (DPA)

4.1 Object

This DPA governs data processing operations performed by HINDT as Processor.

4.2 Processor Obligations

HINDT shall:

  • process data solely under instructions,
  • implement security measures,
  • notify of breaches without undue delay,
  • ensure confidentiality,
  • avoid subcontracting without notice.

4.3 Controller Obligations

The Controller shall:

  • ensure lawful data collection,
  • provide precise instructions,
  • guarantee the accuracy and legality of submitted data,
  • bear full responsibility for NDT content.

5. SERVICE LEVEL AGREEMENT (SLA)

5.1 Availability

Target uptime: 99% (non-guaranteed).

No service credits provided.

5.2 Support

Support is provided via email within 2–5 business days.

5.3 Maintenance

The Provider may perform updates, patches, or maintenance without prior notice.

5.4 Backups

Internal backups may occur, but:

  • recovery is not guaranteed,
  • backups are not a contractual obligation,
  • users must maintain external backups.

6. IN-APPLICATION DISCLAIMER (REPORT EXPORT)

Before exporting a report, the user acknowledges:

  • all content originates from user-submitted data,
  • the user bears full responsibility for accuracy and validity,
  • the Application serves only as a formatting and organizational tool,
  • HINDT bears no liability for consequences of exported reports,
  • independent verification is required for any technical, engineering, contractual,
    or regulatory use.

7. FINAL PROVISIONS

If any clause is deemed invalid, remaining clauses remain in effect.

Failure to enforce any right does not constitute a waiver.
